These GTC govern the relationship between you (referred to in these GTC as “You” or the “Customer”) and B2X Service Solutions India Private Limited (referred to in these GTC as “Us” or “B2X”) regarding the servicing of a Customer’s Google-branded device (the “Device”).
Any services provided by Us shall be subject to these GTC.
B2X will undertake repair services in relation to a Device. The repair services to be undertaken are identified by Us as necessary (a) on the basis of the details You provide Us; (b) on the basis of B2X’s examination of the Device to be repaired; and (c) during the course of the repair work.
B2X’s remuneration for the repair services is based on individual estimations shared to You on the basis of the individual services performed. B2X’s rates applicable at the time of the repair will be charged.
Any spare parts required will be invoiced separately.
Shipping costs (packaging, transport and insurance) are included in the rates payable by You.
Tax at the statutory rate will be charged on B2X’s prices.
To be eligible to make a Device repair claim under warranty and obtain repair services free-of-charge, You must provide the original Device Proof of Purchase (“POP”). In case a POP is not provided, B2X relies on the available information for Your Device and, consequently, may not correctly determine the warranty status of the Device. In case the Device is found to be out of warranty; be dead; has no display; is liquid damaged; has internal damage, any evidence of tamper; and/or any other physical damage, the Device will be treated as an out of warranty repair and B2X’s rates applicable at the time of the repair will be charged.
B2X’s invoices are due without any deductions as soon as B2X has provided the repair services and issued an invoice.
Immediately upon default of payment B2X is entitled to demand default interest of 5 percentage points above the base lending rate p.a. B2X reserves the right to claim higher actual damages.
The repair costs stated in cost estimates are guidelines estimated on the basis of the information You provide and following the examination of the Device. B2X cannot guarantee the accuracy of the figures contained. If while repairing the Device it becomes clear that more extensive repair work is necessary, B2X is authorized to complete the services without seeking confirmation from You, provided this does not cause the overall repair costs to exceed the estimated price by more than 15%. Otherwise B2X will inform You that B2X expects the cost estimate to be exceeded and you will be presented with a new estimate.
If on the basis of a cost estimate You decide not to proceed with the performance or continuation of the repair services, B2X is entitled to charge for the cost of preparing the cost estimate and for any services performed up to that point.
In case you reject the estimation, we will return your device un-repaired. Your Pixel phone will be wiped to factory settings before it is shipped back to you and it might not be delivered in the same condition in which it was picked up.
B2X will start carrying out the repair services You have assigned to Us within a reasonable period. Unless a binding deadline has explicitly been agreed, completion deadlines of which You are notified are non-binding. B2X will carry out on-site repair services within a reasonable period within the framework of sensible planning for B2X’s service staff.
If the performance of B2X’s obligations is delayed or impeded by circumstances which cannot be prevented with reasonable care, in particular by force majeure, strikes, lockouts, stoppages, scarcity of materials and energy, incorrect or late delivery despite a careful choice of supplier, the period of the repair service will be extended by the duration of the hindrance. If You provide substantial evidence that You cannot reasonably accept such an extension, You are entitled to withdraw from this contract, without the right to any claim for damages, in so far as the contract has not yet been fulfilled. Any further claims You may assert are excluded.
B2X can only process complete repair of a device so that there are no further issues. As per the repair policies, we don´t process partial repairs as the device won't be able to pass the quality checks post the repair.
The risk of damage to or loss of the repaired Device passes to You as soon as the repaired Device has been delivered.
B2X will remove all data, including all confidential and personal data, from the Device before returning it to You. It is the Customer’s sole responsibility to back-up any files or data that You wish to retain. B2X does not accept any responsibility or liability for any lost files or data.
If any defective parts are replaced during an in-warranty repair, those defective parts will not be returned to the Customer and any screen guard on the Device will be removed from the Device and B2X will have no liability to return it to the Customer.
After the repaired Device has been received, You are obliged to inspect the Device upon delivery and accept the duly performed repair services immediately upon delivery.
If You refuse to accept the repair services performed, and delivery of the Device delivery, B2X will have the discretion to retain the Device and it will become the property of B2X. You release B2X from any further claims in respect of the Device and B2X will not be responsible for returning the Device. Nothing in this clause limits the Customer’s liability for payment of the repair service costs.
B2X will meet warranty obligations by remedying defective repair services free of charge and by repairing or replacing defective material free of charge, if You demonstrate to B2X that a repair is defective or has not been carried out properly. If the remedial work undertaken by B2X fails, You have the right to demand a price reduction or rescission of the repair contract.
If faults occur in a repaired Device which are not caused by a defective repair (including, without limitation, faults due to natural wear and tear, caused by improper handling or other outside influences) these will not be covered by the warranty.
If You assert warranty claims You must notify B2X of defects which have occurred immediately after they have been discovered and take all steps to minimize any damage caused by a defect.
The period of warranty shall be 30 days from the date of completion of the repair services by B2X. The restart of the period of warranty shall be excluded except in cases of intent or gross negligence. Parts replaced during the repair are genuine parts and the warranty on replaced parts is valid for a period of 30 days from the date of completion of the repair services by B2X.
If B2X determines, in its absolute discretion, that the case does not fall under the warranty, the performance and invoicing of the examination and, where appropriate, elimination of the fault will be carried out under these GTC at the current price.
Data relevant to the handling of this contract may be stored by B2X and by companies in the B2X group. IMEI and SN of the device will be captured along with the test results from the diagnostic app. No other Customer personal user information will be captured.
B2X may, at any time, and at B2X’s sole discretion, modify these GTC, with or without notice to You. Any such modification will be effective immediately upon public posting. A Customer’s continued use of B2X’s services following any such modification constitutes a Customer’s acceptance of these modified GTC.
Governing law shall be the law of Mumbai, India with the exclusion of the international conflict of laws provisions thereof and with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Should any of the clauses of these GTC be wholly or partially invalid or void, the validity of the remaining clauses or parts thereof shall not be affected.
The Customer acknowledges and agrees that, by reading/signing the Customer Acknowledgement Form, the Customer is deemed to have accepted and agreed to these GTC.
